Welcome to SellingerAI! These Terms and Conditions (“Terms”) govern your access to and use of the SellingerAI website, services, and applications (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use SellingerAI.
1. Definitions
“Account” means your user registration with SellingerAI.
“User,” “you,” or “your” means any person or entity using or accessing the Services.
“Content” means all text, data, graphics, images, messages, and other information uploaded, generated, or otherwise provided through the Services.
“Subscription” refers to the single paid plan for access to the Services, as described in Section 5.
2. Acceptance of Terms
By creating an Account, subscribing, or otherwise accessing or using the Services, you acknowledge that you have read, understood and agree to be bound by these Terms, our Privacy Policy, and any additional terms or policies referenced herein.
3. Eligibility
You must be at least 18 years old and capable of entering into binding contracts to use the Services. By registering, you represent and warrant that you meet these requirements.
4. Account Registration & Security
Registration: To access the Services you must register and provide accurate, current, and complete information.
Credentials: You are responsible for maintaining the confidentiality of your username and password and for all activities under your Account.
Notification: You agree to promptly notify SellingerAI of any unauthorized use or security breach.
5. Subscription Plan & Fees
Single Plan: We offer one subscription plan: the LinkedIn AI Agent, at $80 USD per month.
Billing: Fees are billed in advance on a monthly basis. All payments are non-refundable except as required by law.
Changes to Fees: We may modify fees for future billing periods upon at least 30 days’ notice. Your current term’s fees will not change mid-term.
Taxes: You are responsible for all applicable taxes, levies, or duties.
6. Free Trial
If we offer a free trial, functionality or connection volumes may be limited. The trial ends automatically at the end of the trial period unless you subscribe to the paid plan.
7. Permitted Uses & Restrictions
Permitted Uses: You may use the Services for lawful B2B LinkedIn outreach in compliance with LinkedIn’s policies and applicable laws.
Restrictions: You will not:
Reverse-engineer, decompile, or disassemble any portion of the Services.
Circumvent technical restrictions (e.g., rate limits).
Send spam or unsolicited communications.
Use the Services to stalk, harass, or defraud any person.
Resell the Services or provide them as a service bureau.
8. Intellectual Property
Ownership: SellingerAI and its licensors retain all rights in the Services and related intellectual property.
License to You: Subject to your compliance, we grant you a limited, non-exclusive license to use the Services during your Subscription term.
User Content: You retain ownership of Content you upload or generate. By providing Content, you grant SellingerAI a worldwide, royalty-free license to use, reproduce, and display it as necessary to provide the Services.
9. Data Protection & Privacy
We process personal data in accordance with our Privacy Policy. You are responsible for obtaining necessary consents for any personal data you upload or use.
10. Security & Compliance
Security Measures: We implement industry-standard controls (SOC-2, SSO/SAML support) to protect your data.
GDPR/CCPA: We comply with applicable data-protection laws. You may request data deletion or export via support.
11. Disclaimers & Warranties
“As-Is” Basis: The Services are provided “as is” and “as available,” without warranty of any kind.
No Guarantee of Results: We do not guarantee specific outreach volumes, connection rates, or business outcomes.
Third-Party Services: We are not responsible for LinkedIn’s availability, policies, or changes affecting our integration.
12. Limitation of Liability
To the maximum extent permitted by law, in no event will SellingerAI or its affiliates be liable for:
Any indirect, incidental, special, consequential, or punitive damages.
Loss of profits, revenue, data, or business opportunity.
Your use or inability to use the Services, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless SellingerAI and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with:
Your breach of these Terms.
Your misuse of the Services.
Any Content you upload or transmit.
14. Termination
By You: You may cancel your Subscription at any time via your Account settings; termination takes effect at the end of your then-current billing period.
By Us: We may suspend or terminate your Account for violation of these Terms or LinkedIn’s policies, without refund.
Effect of Termination: Your rights to access the Services immediately cease. We may delete or anonymize your Content after 30 days.
15. Modifications to These Terms
We may update these Terms from time to time. If changes are material, we will notify you at least 30 days before they take effect. Continued use after changes constitutes acceptance.
16. Governing Law & Dispute Resolution
These Terms shall be governed by the laws applicable to your place of residence. Any dispute arising under these Terms shall be resolved in the courts of your jurisdiction.
17. Miscellaneous
Entire Agreement: These Terms (including referenced policies) constitute the entire agreement between you and SellingerAI.
Severability: If any provision is unenforceable, the remainder remains in full force.
Waiver: Our failure to enforce any right is not a waiver of that right.
